Maximum Medical Improvement (MMI), is a state you may reach following your accident where you’ve healed as much as your body is going to be able to. Your physicians have no more treatment options for you and you must live with any remaining symptoms that are still present.

Insurance companies are reluctant to determined when a person has reached MMI because it is at this point that the conversation for ongoing or long-term financial restitution begins. You’ll be assessed to determine what, if any, abilities you have to work or train for a new job and what resources are available to help you do that.

Suing For Permanent Disabilities

If you are permanently injured or disabled as a result of your car accident, you may be able to file a lawsuit against the other driver who caused the collision. You will need to prove the following elements in order for your claim to be successful:

  • The other driver was negligent; and, 
  • The other driver’s negligence resulted in an accident; and, 
  • The accident directly caused you to become injured; and, 
  • Your injuries caused you to incur damages; and 
  • Your medical condition is not expected to further improve; and, 
  • You will require ongoing medical care and/or your income will be impacted by the permanence of your injury.
